Applicable legal framework

This Policy is governed by the laws of the Republic of Paraguay, in particular:

• Law No. 1682/2001, amended by Laws No. 1969/2002 and No. 6534/2020, regulating private information and personal data protection.
• Articles 33 and 36 of the National Constitution of Paraguay, regarding the right to privacy and the inviolability of documentary heritage and private communications.
• Law No. 4868/2013 on Electronic Commerce.

Additionally, we apply international best practices in data protection (including principles of the GDPR and Brazilian LGPD) when serving clients in jurisdictions that require them.

When you complete the contact form on the website, we collect:

• Name: to personalize communication.

International transfers

Some of our providers process data outside Paraguayan territory (primarily in the United States and European Union). In all cases, we require the provider to adopt reasonable safeguards and contractual mechanisms ensuring that your data is protected to the level required by Paraguayan law.

Data retention

We retain your personal data only for the time necessary to fulfill the purposes for which it was collected, unless the law requires a longer period:

• Contact-form data: up to 24 months after the last interaction, unless the data subject objects.
• Contractual client data: during the contract term and for 10 years after termination, in accordance with Paraguayan tax and commercial law.
• Technical logs (IP, user-agent): up to 90 days, unless required for security investigations.

Data subject rights

Pursuant to Law No. 1682/2001 and its amendments, the data subject may exercise, at any time and free of charge, the following rights:

• Access: request a copy of the personal data we process about you.
• Rectification: update or correct inaccurate or incomplete data.
• Erasure: request deletion of your data when it is no longer necessary.
• Objection: object to processing for reasons related to your particular situation.
• Portability: receive your data in a structured, commonly used format.
• Withdrawal of consent previously granted, without retroactive effect.

Information security

We apply reasonable technical and organizational measures to protect your data against unauthorized access, loss, alteration or improper disclosure:

• In-transit encryption via TLS 1.2+ on all communications.
• Credential storage with restricted permissions and periodic rotation.
• Servers with active firewalls and continuous monitoring.
• Access to data restricted to personnel strictly necessary.

In the event of a security incident with potential impact on data subjects, we will report the facts to the competent authority and affected individuals as required by applicable law.

Minors

The site and MS Solutions' services are intended exclusively for persons aged 18 and over. We do not intentionally collect personal data from minors. If we become aware that a minor has provided us with data without parental consent, we will proceed with its immediate deletion.

Cookies and similar technologies
